Une infection sur prothèse est reconnue comme infection nosocomiale pendant 1 an après sa mise en place.

La loi du 04 mars 2002 (loi Kouchner) a considérablement modifié les conditions de responsabilité dans ce domaine. Il existe une présomption irréfragable (à laquelle on ne peut se soustraire) de responsabilité en faveur de l’établissement de soins dans lequel a été implantée la prothèse.

Nous sommes sensés travailler dans des conditions d’asepsie parfaite.

Nous devons une sécurité de résultats, notion qui se substitue à l’ancienne obligation de moyens.

Les jugements prononcés tendent tous vers l’obtention par le patient d’une réparation des dommages subis.

Grâce à ces nouvelles dispositions, les conflits nés des accidents médicaux, paraissent plus souvent apaisés.

During 1 year, an infection for prosthetic surgery, is recognized as nosocomial infection.

The law of 4 march 2002 (Kouchner law ) has deeply modified responsability conditions in this field. There is an absolute responsability for hospital when a prosthetic infection occurs.

We are supposed to work in perfect conditions of asepsis.

We must give to our patients a perfect security for results and we have not only an obligation of means as in the past.

Legal decisions are always elaborated in order to give to the patient réparation of dammage.

With these new dispositions, conflicts due to médical accidents seem to be more calm.
